The Dairy Fairy mobile message service (the "Service") is operated by The Dairy Fairy, LLC (“The Dairy Fairy”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply.
Text messages may be sent using an automatic telephone dialing system or other technology. Your consent to receive autodialed marketing text messages is not required as a condition of purchasing any goods or services. By entering your phone number in the checkout and initializing a purchase, subscribing via our subscription form or a keyword, you agree that The Dairy Fairy may send you text notifications and text message marketing offers such as: updates, alerts, information (e.g., order updates, account alerts, etc.), promotions, specials, and other marketing offers (e.g., cart reminders) through your wireless provider to the mobile number you provided. Message frequency varies. Text the single keyword command STOP to +1 (855) 923-7513 to cancel at any time. You'll receive a one-time opt-out confirmation text message. If you have subscribed to other mobile message programs from The Dairy Fairy and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms. We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. You agree to maintain accurate, complete, and up-to-date information with us related to your receipt of messages.
You agree to indemnify, defend, and hold us harmless from any third-party claims, liability, damages or costs arising from your use of the Service or from you providing us with a phone number that is not your own.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

30 days from receipt for online orders from our site, on any unworn, unwashed items in re-sellable condition, not marked as Final Sale.

Termination/Access Restriction
TDF reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of California and you hereby consent to the exclusive jurisdiction and venue of courts in California in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and TDF as a result of this agreement or use of the Site. TDF's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of TDF's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by TDF with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and TDF with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and TDF with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
Changes to Terms
TDF reserves the right, in its sole discretion, to change the Terms under which thedairyfairy.com is offered. The most current version of the Terms will supersede all previous versions. TDF encourages you to periodically review the Terms to stay informed of our updates.
